Please read these Terms of Use ("Terms") carefully before using Respira Pulse ("the Application", "the Service"). By downloading, installing, or using Respira Pulse, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, accessing, or using Respira Pulse, you acknowledge that you have read, understood, and agree to be bound by:

• These Terms of Use
• Our Privacy Policy (available at /privacy-policy)
• All applicable laws and regulations

Your use of the Application constitutes your acceptance of these Terms and the Privacy Policy. If you do not agree with any part of these Terms or the Privacy Policy, you must not use the Application and should uninstall it immediately.

Since Respira Pulse does not require user accounts or collect personal information that could be used to track individual users, we cannot provide an in-app mechanism for explicit acceptance. By using the Application, you are providing implicit consent to these Terms and our Privacy Policy through your actions.

2. Description of Service

Respira Pulse is a macOS desktop application that monitors Vercel deployments and provides real-time status updates through the macOS menu bar. The Application requires:

• A valid Vercel account
• macOS operating system
• Internet connection for API access and license validation

3. License Tiers and Pricing

Respira Pulse offers the following license tiers:

3.1 Free Trial

• Duration: 7 days
• Access: Unlimited features during trial period
• No payment required
• Automatic expiration after 7 days

3.2 Starter License

• Price: €4.44 (one-time payment)
• Includes: Monitoring for 1 Vercel project
• Lifetime access (one-time purchase, no recurring fees)

3.3 Pro License

• Price: €22.22 (one-time payment)
• Includes: Monitoring for up to 10 Vercel projects
• Lifetime access (one-time purchase, no recurring fees)

3.4 Unlimited License

• Price: €44.44 (one-time payment)
• Includes: Monitoring for unlimited Vercel projects
• Lifetime access (one-time purchase, no recurring fees)

4. License Provider

Licenses are sold through LemonSqueezy. When you purchase a license, you will be redirected to our LemonSqueezy checkout page:

Your license purchase is subject to LemonSqueezy's terms and payment processing policies.

5. Acceptable Use

5.1 Permitted Uses

You may use Respira Pulse for:

• Personal use
• Commercial use
• Monitoring your own Vercel projects and deployments

5.2 Prohibited Uses

You agree not to:

• Redistribute, resell, or sublicense the Application
• Reverse engineer, decompile, or disassemble the Application
• Modify or create derivative works based on the Application
• Use the Application to monitor Vercel projects you do not have authorized access to
• Use the Application in any way that violates Vercel's Terms of Service
• Use the Application in any unlawful manner or for any unlawful purpose
• Attempt to bypass license restrictions or validation mechanisms

6. Requirements

To use Respira Pulse, you must:

• Have a valid Vercel account
• Be authorized to access the Vercel projects you wish to monitor
• Have appropriate API access permissions in your Vercel account
• Use the Application in compliance with Vercel's Terms of Service

7. License Activation and Validation

• Licenses are activated using a license key provided after purchase
• License validation occurs through the LemonSqueezy API
• License status is checked periodically to ensure validity
• Attempts to use invalid or expired licenses will result in restricted access

8. Updates and Maintenance

8.1 Automatic Updates

Respira Pulse may notify you of available updates through:

• In-app update notifications
• GitHub release notifications

8.2 Updating the Application

You can update Respira Pulse using Homebrew:

Updates are included with your license purchase at no additional cost.

10. Warranty Disclaimer

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or availability of the Service

We do not warrant that:

• The Application will meet your requirements
• The Application will be uninterrupted, timely, secure, or error-free
• Any errors in the Application will be corrected
• The Application is free of viruses or other harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Vercel API issues, downtime, or service interruptions
• Any issues arising from unauthorized access to your Vercel account
• Any damages resulting from your use or inability to use the Application

Our total liability shall not exceed the amount you paid for your license (if any) in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Respira Pulse, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Application
• Your violation of these Terms
• Your violation of any third-party rights, including Vercel's Terms of Service
• Any unauthorized use of your Vercel account credentials

13. Third-Party Services

13.1 Vercel

• The Application requires access to the Vercel API
• Your use of Vercel's services is subject to Vercel's Terms of Service
• We are not responsible for Vercel API issues, downtime, or changes to Vercel's API

13.2 LemonSqueezy

• License purchases are processed through LemonSqueezy
• Payment processing is subject to LemonSqueezy's terms and policies
• We are not responsible for payment processing issues

14. Termination

14.1 By You

You may stop using Respira Pulse at any time by uninstalling the Application. However, license purchases are non-refundable except as required by law or at our sole discretion.

14.2 By Us

We reserve the right to terminate or suspend your access to the Application at any time, without notice, for any reason, including if you:

• Violate these Terms
• Use the Application in an unlawful manner
• Attempt to circumvent license restrictions

15. Refund Policy

License purchases are one-time payments and are generally non-refundable. However, we may consider refunds on a case-by-case basis in the following circumstances:

• Technical issues that prevent the Application from functioning and cannot be resolved through support
• Duplicate purchases made in error
• As required by applicable consumer protection laws

16. Intellectual Property

Respira Pulse, including its code, design, and branding, is the property of its developers and is protected by copyright and other intellectual property laws. Your license grants you a limited, non-exclusive, non-transferable right to use the Application in accordance with these Terms.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Updating the "Effective Date" at the top of these Terms
• Posting a notice in the Application
• Sending an email notification (if you have provided your email for support)

Your continued use of the Application after changes are posted constitutes acceptance of the modified Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between you and Respira Pulse regarding the use of the Application and supersede all prior agreements and understandings.
